Terms and Conditions

In this agreement “us,” “our,” and “we” refer to Consology Logistics., its affiliates, employees, agents, contractors, and subcontractors. “You” and “your” refer to the box holder, member, subscriber, receiver, customer, consignee, its agents, employees and anyone claiming an interest in the shipment. “Packages” or “package” means any container, merchandise, goods that are accepted by us for delivery. “Shipment” or “shipments” means all packages and mail which are tendered to and accepted by us on a single house air waybill. 

AGREEMENT TO TERMS
By activating and using the Consology Logistics Limited services, you are acknowledging that you have understood, read, and agreed to accept the Terms and Conditions of this agreement. You agree that your shipments may or will be carried through familiar places that shipments may stop including a country other than the country of departure and we may substitute alternate aircraft or carriers. 
Please note the following services provided and restrictions applied by Consology Services  Ltd.
Packages can be shipped to your Consology address via Any Postal Service, Hand or personal delivery Domestic or Courier Services Consology Logistics is not liable for damage or loss of items while handled by overseas Postal and Courier authorities.

CD’s, Books, Clothes
Electronic Items, Accessories, Radios, Computers, etc.…
Restricted Commodities

Hazardous materials, animal skins, firearms, perishables, aerosol cans, perfumes, etc.
We do not accept nor deliver any magazines or mail subscriptions.
We do not accept for shipment currency, cash or other security instruments.
Dangerous goods and Hazardous Materials.
Any goods or packages, which are considered by (DOT) (the Department of Transportation), lATA (the International Air Transportation Association )  and  and/or the International Civil Aviation Organization (ICAO) as “restricted articles”,  or “dangerous goods”, or “hazardous materials”, may be sent into Trinidad either via airfreight  via Ocean shipping or as cargo.

Items that are commonly shipped such as perfumes will automatically be sent via Ocean shipping, which may take approximately two weeks to arrive in Trinidad and Tobago. Customers requiring the faster option of shipping Hazardous items via Air Freight should contact us to make the needed arrangements and cost estimates.  Costs associated with shipping hazardous materials will be evaluated on an individual basis and will not be reflective of the rates mentioned on this site. This is primarily due to the cost associated with the unique handling, packaging, and paperwork required to handle hazardous material or dangerous goods.

OTHER PROHIBITED ARTICLES
You agree to use Consology Logistics service only for lawful purposes and conform to all local, state, federal,  government and postal regulations in Europe and the US. You further agree that you shall not permit, nor use the shipping address to be used to send, receive, deliver, or store items of significant intrinsic value such as negotiable securities, cash, furs,  jewelry, or similar items.


WEIGHT AND PACKAGE INFORMATION
Consology Logistics Ltd fees are calculated based on the actual weight of items rounded up to the nearest pound(lb), e.g., a 3.3lb package will attract a 4lb rate. Packages that are excessively bulky may require repacking at client’s cost. Contact our office for further details.

NUMBER OF ACCOUNT USERS
A company or individual will be listed as the accounts' Primary holder, and a maximum of two other individuals could be recorded as Authorized Contacts.
The (PAC) Primary Account Holder will be responsible for all deliveries and charges that are incurred to one address.

DUITABLE SHIPMENTS
A delay in your shipment may occur if it does not contain an invoice. Regardless of the value of the delivery, it must have an invoice with a cost and must accompany all non-documented shipments. 
Customer’s shipments consisting of books, clothes, CD’s, documents, etc., will be cleared automatically as “Non-Trade” unless arrangements have been made before writing. Customs & Excise requests that a “Formal Entry” should be done for “Trade” shipments that are “Dutiable” or incur taxes: therefore, you will receive the necessary documentation for clearance in these instances. Consology Logistics Ltd. can assist in the lodging and preparation of “Formal Entries,” which you should require. Duty paid on “Non-Trade” shipments (on your behalf) is C.O.D. (Cash on Delivery) ONLY. Note* ‘Non-Trade’ shipments are items imported for personal use only and not for profit. Trade shipments are packages imported for commercial use and value which exceeds the legal amount TTD 20,000 for ‘Non-Trade’ Customers choosing. Platinum and Corporate accounts are subject to additional fines if they do not ship the minimum freight weight requirements.

LIMITATION OF CLAIMS
We will reject any item shipped to our address opened or damaged and will inform the consignee provided the package still permits identification of the relevant client consignee. No claims will be accepted nor honored by us concerning these items, and we will have no liability or responsibility.

LIABILITIES NOT ASSUMED
The responsibility of Consology Logistics Ltd. begins when the packages are received at the warehouse of the agent in Miami. Consology Logistics Ltd will not be held liable for packages that are lost, delayed or damaged while in transit to the warehouse. We will not be responsible for any dammages, or delays in delivery of any kind (whether  indirect, direct, incidental, special, or consequential) including but not loss of interest, limited to loss of income,  loss of business opportunity, loss of profit,  breach of other contracts, loss of use of contents,, or any dammage or loss arising from the  nature of the goods, whether or not we have knowledge that such damage might incur, even if the delay is our fault in retrieving the shipment, or transporting the cargo, or delivering the consignment. We will not be liable for your acts or omissions, including but not limited to the incorrect declaration of goods, improper or insufficient packaging or mark or address of the shipment, or for acts or omissions by the consignee or consignor or anyone else with interest in the shipment.

The customer shall be responsible for ensuring that an invoice accompanies every shipment. Failure to do so may result in delays and abandonment of shipments.
Where shipments arrive without proper documentation Consology Logistics Ltd will ship the goods to Trinidad and notify the consignee in Trinidad. Consology Logistics Ltd. will provide clients with a delivery notification and a copy of the air waybill to be presented for clearance. This will end Consology Logistics Ltd liability for the goods and payment will become applicable immediately. The clients may choose to have the supplier provide an additional or duplicate invoice and have it sent to Trinidad and Tobago or may present evidence of value to Customs for clearance of the cargo. All necessary storage and relevant fees will be for the consignee’s account pending an invoice being produced for said clearance.  Also, we will not be responsible if you or the consignor/shipper violates any of our TOS. 

Also, we will not be held liable for the loss, damage, or delay caused by any events beyond our control including but not limited to acts of God, “force majeure”, or omissions or the action  of any governmental or public authority (including but not limited to  health officials or Customs), or failure by anyone outside of Consology Logistics. We reserve the right, without admitting liability, to refund transportation charges at our sole discretion, but are not obligated to do so.

INSURANCE

Insurance is charged at a rate of USD 1.00 per USD 100 value of your package up to $300USD.
Packages without an invoice will only be insured for the sum of USD$100.00 maximum. Please, note that your rate of USD 1.00 does not cover the following :

Microwave ovens
Flatbed scanners
Monitors
Any other glass,  ceramic, porcelain, or concrete products.
Any improperly or inadequately packaged items from the shipper.
Shipping charges will not be covered by the insurance.
Insurance rates and services are subject to change without notice

USE OF FOREIGN SHIPPING ADDRESSES
We will provide a physical street address for your exclusive use. The rights to the physical street address belong to us. Access to the foreign addresses is restricted to Consoloy personnel. You are only permitted to have packages sent to the shipping addresses and to have the shipments on-forwarded to a destination.

DELIVERY / COLLECTION
Consology Logistics Ltd standard delivery service is to deliver free of charge to your office/home address. 
Two attempts would be made to deliver your packages between the times 8:00 a.m. and 4:00 p.m., on the days Monday through Friday. If no one is available to receive your packages, a note will be left to advise you of a failed attempt. Your packages will then be sent to our office where you may collect or make arrangements to have the packages redelivered.

Our redeliver fee is $35.00 TT - There is no charge to collect at our office.

Packages will be held for fourteen (14) days. Failure to collect will result in a storage fee of $10.00 TT per package EACH day until collected.
If you do not require Consology’s standard delivery service, you can send a request for your cargo to be held for collection at our facility. This request must be sent via email to [email protected] before 3.00 pm the day before delivery.

LIMITATION OF CLAIMS
We will identify packing materials (i.e., boxes, tubes, cartons,  envelopes, etc.) that are damaged or opened in condition upon arrival at our physical address, and will note the state that your package has arrived. No claims will be honored nor accepted by us concerning these items, and we will have no responsibility or Liability. 

LIMITATIONS OF LIABILITIES
Based on international transportation charges for the movement of unspecified packages by Consology Logistics Limited it is agreed that we will have no liability to you.

LIABILITIES NOT ASSUMED
We are not liable for any damages or delays in delivery of any kind including but not limited to loss of interest, profit,  business opportunity, income, use of contents, contract breach, or any loss or damage arising from the nature of the goods, regardless if we had knowledge that such cost might be incurred or not. This is true even if we are liable for the delay in retrieving the shipment, transporting the shipment, or delivering the shipment. We will not be responsible for your acts or omissions, including but not limited to the incorrect declaration of goods, improper or insufficient packaging or mark or address of the shipment, or if any relevant information is left out by the consignor or consignee or anyone else with interest in the cargo or shipment. Also, we will not be responsible if you or the consignor violates any of our Terms of Service. We do not accept deliveries of Currencies, cash, or other security instruments. 

NO WARRANTIES
We make no warranties, express, or implied.

RIGHT TO SCREEN
As per the Transportation Security Administration (TSA) Regulations: All individuals that are shipping, and sending cargo or packages to International Bonded Couriers Inc. in the U.S. for transport: by reading this message, we have your permission for screening all merchandise/shipments. Inclusive of inspections, and understand that shipments will not be accepted if found to be dangerous or illegal for air transport.

RIGHT TO INSPECT
The shipment may, at our option or the request of Trinidad and Tobago governmental authorities, be opened and inspected by us or such authorities at any time.

RESPONSIBILITY FOR PAYMENT
Opening an account with Consology Logistics Ltd does not qualify you for a credit facility. Concerning Consology Logistics Ltd,  you will always be primarily responsible for all charges including all duties, customs assessments, transportation charges, governmental penalties and taxes, fines, brokerage fees,  and our attorney fees and disbursements related to your cargo in the case of default in payment. Credit is granted by accounts department at their discretion and based on account standing. It may be revoked immediately if our TOS agreement is not met. Consology Logistics reserves the right to request full or partial payment on any shipment at any time if the amounts exceed the usual credit line we are prepared to grant. 

We are not obligated to advance any external fees such as customs, government, or carrier’s taxes or assessments, penalties, fines, or any other clearance fees, and may at our sole discretion request cash or certified funds from you before submitting an entry for clearance to Customs.  If payment is not made before or upon delivery, the outstanding balance shall bear an additional service and handle charge at the rate of 1½percent per month and we may turn the said account over to an attorney for collection.

if an attorney is needed for collection of payment, it is understood that any fees incurred will be added to the balance due to cover any additional expenses incurred by the attorney for his /her services. 
Any disputes hereunder, including any litigation or claim which you may have.  If any provision herein is found to be invalid,  ambiguous, unenforceable, and illegal, such rule shall not affect the remaining rules, and such remaining provisions shall continue in full force and effect.

ABANDON/UNCLAIMED SHIPMENTS
Any and all shipments that have not been claimed or accepted by the consignee or is undeliverable due to error on the part of the shipper, consignee, or for which no disposition instructions have been provided within the 30 days of its arrival shall be considered unclaimed/abandoned. 
At this point, Consology Logistics will own unclaimed/abandoned packages. All unclaimed cargo or packages will be sold to recover costs associated with said package/s. 

CUSTOMS DUTIES, VAT, FREIGHT & HANDLING CHARGES
You agree to pay all charges imposed by the Government of Trinidad & Tobago, or any other government and agency, and the carrier concerning your mail and packages. You agree to pay any customs clearance charges imposed by us or our affiliates concerning your packages and mail. We reserve the right to adjust our fees to reflect any significant fluctuation in foreign exchange rates, and you agree to pay all such additional charges concerning your mail and packages. Shipments valued under TT $20,000.00 CIF (Cost, Insurance, and Freight) will be cleared as a “Non-Trade Entry” by us unless prior arrangements have been made by you in writing to Consology Logistics’ Trinidad office. “Non-Trade” shipments are packages imported for personal use only. 

For shipments valued under & over TT $20,000.00 CIF (Cost, Insurance, and Freight) the Comptroller of Customs and Excise requests that a “Formal Entry” be done for “Trade” shipments. These “Trade” shipments are packages imported for commercial use and not for personal use. Upon receipt of your written approval and power of attorney, make an entry on your behalf and clear the goods for an additional fee.  If you would like to process shipments yourself, all of the inbound paperwork will be delivered to you. Vat, Taxes, Duties, levies, imposts, deposits, or outlays, and other charges are not included in the shipping rates and will be determined by the relevant Customs agencies, or other authorities using the vendor’s or supplier’s invoice that accompanies your cargo. 

SUBSCRIPTION
Your subscription is free of charge and does not require any renewal fee. We can terminate this agreement without notice. You will still be liable for all costs resulting from the arrival of any and all mail and packages. Also, upon termination, we will have the right to return all merchandise or mail to the sender and bill your account for that service based on the published courier tariff currently up to date.

CONSOLOGY LOGISTICS LIMITED RESERVES THE RIGHT TO AlTER, REVOKE, AMEND ANY OF THE TERMS AND CONDITIONS, IN ADDITION TO ANY SERVICE, FEATURE, OR RATE WITHOUT NOTICE.
